If you apply but cannot meet all the requirements for this category, you will be refused. Please see 'More information' below for further information. If we refuse our application your fee will not be refunded.
You must show that:
you and your partner are both aged 18 or over at the date of application;
your partner is not related to you in a way that means you could not marry in UK law;
you and your partner have met in person;
your relationship with your partner is genuine and subsisting;
if your relationship is genuine and subsisting we would expect you to be able to show evidence
that you:
are in a current, long-term relationship;
are living together with your partner;
share responsibility with your partner for any children;
share financial responsibilities with your partner, such as a joint mortgage or tenancy
agreement, a joint bank account or joint savings, and utility bills in both your names;
and your partner have visited one another's home country and family; and
you have made plans about living together in the UK with your partner.
if you are married or in a civil partnership, your marriage or civil partnership is valid in UK law;
you meet the suitability requirements;
any previous relationship has permanently broken down (this does not apply to certain polygamous relationships);
you and your partner intend to live together permanently in the UK;
you meet the financial requirement;
you meet the English language requirement; and
if you are in the UK and want to extend your leave or apply for settlement in the UK you will need to meet the suitability requirement.We encourage you to apply 28 days before the expiry date, but you can choose to apply earlier than this.
If you do not send us all the documents we need when you make your application, we may refuse your application because of insufficient evidence, and your fee will not be refunded.
You must send:
2 recent passport photographs and your passport - see the Photographs and passport page
evidence of your age and your partner's age
your marriage or civil partnership certificate
evidence that you were both free to marry or enter your civil partnership, if either of you was previously married or in a civil partnership
evidence that you have met
evidence of your English language ability - see the English language page
If you are not an English speaker, you must pass a course in English for speakers of other
languages (ESOL) which contains citizenship materials.
In England, Wales and Northern Ireland, you can study ESOL at the 3 entry levels:
ESOL Entry 1 (lowest)
ESOL Entry 2
ESOL Entry 3 (highest)
evidence that you meet the financial requirement.
Applications from inside the UK
If your application to switch into this category is successful, we will grant you permission to remain in the UK (known as 'further leave to remain') for 30 months. Shortly before the end of that period, you can apply for further leave to remain in the UK. If you still meet the requirements you will be granted permission to stay for a further period of 30 months. Once you have completed 5 years in the UK, as the partner of someone who is a British citizen or settled in the UK, you can apply to settle here. This is known as 'indefinite leave to remain'.
